VERIFICATION OF PROPERTIES ON THE ARDHISASA PLATFORM

LEGAL FRAMEWORK
Following the passage of the Land Registration Act 2012, the Registrar of Lands was mandated to maintain files in an electronic format which can be accessed by members of the public.
To this end, the government through the Ministry of Lands and Physical Planning formulated the Land Registration (Electronic Transactions) Regulations, 2020 issued vide Legal Notice 101 of June 2019 to provide an enabling framework for the introduction of a system for carrying out electronic land transactions.
These saw the creation of the ardhisasa platform which allows members of the public to access land service and other land related function.
Existing land owners who hold title documents were requested to commence verification process in order for them to have their properties captured under their respective ardhisasa accounts
VERIFICATION
Verification entails the process of migrating all the parcels of land from the repealed land registration statutes to a unitary regime under the Land Registration Act of 2012. This process is carried out on the ardhisasa platform.
VERIFYING OF PROPERTY ON ARDHISASA
The following are the steps taken by an applicant when applying to verify a property
The applicant should ensure the registered owner of the property has an ardhisasa account since the application for verification will be done on the owner’s account. An owner can either be an individual or a corporate.
Once the account is created, the applicant will log in to the owners ardhisasa account and navigate to my properties section on the dashboard. The applicant will then click the add property icon and be directed to add the proprietorship details. This section provides for inputting the land parcel number, indicating whether the proprietor of the land is an individual or company and whether the interest in the land is sole, joint or tenant in common
The applicant will proceed to the next section which is the property detail’s part and the applicant will indicate the type of property being verified. The type of property can either be a leasehold, freehold, sublease or sectional property.
The applicant will then proceed to upload a copy of the title document and also land rent receipt, if available
The applicant can also upload any other additional document that is relevant to the verification process
The application is then submitted and once reviewed and approved by the lands department office, the property will appear in my properties section on the registered proprietors ardhisasa account.
A property once verified will allow the owner to carry out transactions over the said property.
